Terms of sale and use
These are the terms for using fondlytold.com and ordering from Fondly Told. Fondly Told is operated by InfoTech AI, 1111 Oakfield Dr Ste 115E-1699, Brandon, FL 33511, USA ("we", "us"). Questions: hello@fondlytold.com.
By ticking the box at checkout and paying, you agree to these terms, the refund and reprint policy and the privacy policy.
1. What we sell
Printed photo books made from your own Instagram photos and your own words. Each one is made to order, for you, from your content. We show what you can order today on our pages. Anything marked "coming soon" can't be ordered yet.
2. Who can order
You must be 18 or older, and the order must ship to an address in the United States. We don't ship anywhere else for now.
3. How it works
- You ask your AI assistant to make a Fondly Told book. With your approval, it sends us photos from your own Instagram account and, if you agree, your captions, posting times and bio.
- You open your private link. You choose photos, a format and a style. AI models help choose and order the photos and write some of the words.
- You edit anything you like. The book on your screen is your proof.
- When you are happy, you tick the box and pay.
- We check the print files, print your book and ship it to the address you gave at checkout.
There are no accounts. Your private link and your order code are the keys to your book and your order. Anyone who has them can see your book, so keep them to yourself.
An unfinished book is saved for 7 days after your last change. After that it is deleted and you would need to start again.
4. Your proof, and the tick box
You see your whole book before you pay: the cover and every page, as they will print.
Above the pay button is a box that says: "I've looked through my book. Print it exactly like this." You can't pay until you tick it. If you change anything that prints, the box unticks and you look again.
By ticking it you confirm that you have checked the photos, the order, the spelling, the names, the dates and every word, and that you want it printed as shown. We record which version you approved and when.
Colors on paper can look a little different from colors on a screen. Photos are cropped to fit the page as shown in your proof. Small differences like these are normal and are not faults.
5. Some of the words were written by AI
AI models suggest titles, chapter lines, captions and the note on the first page, based on your photos and your own words. They can get things wrong: a place, a name, what is happening in a photo. You can change or remove every word, and nothing prints until you approve it. Once you tick the box, the words are yours and you are responsible for them.
6. After you pay: changes and canceling
Once you pay, your book is locked at the version you approved. You can't change it.
Orders go to print soon after payment. Until yours does, you can cancel it for a full refund: write to hello@fondlytold.com right away, with your order code, and we will do our best. Once it has gone to the printer, we will ask the printer to stop it. Printers allow that only for a short time, and if they stop it, you get a full refund. Once the printer has started making it, it can't be canceled.
When we check your book, if we find a small problem, such as a typo or a bad crop, we may fix it, and we will email you what we changed. If we find a bigger problem, we will write to you before printing.
7. Prices, tax and payment
Prices are in US dollars and are shown before you pay. Standard shipping is included in the price. Where a faster option is offered, its price is shown at checkout. Sales tax is added at checkout where it applies.
Payment is handled by Stripe. We never see your card number. You are charged when you place the order.
8. Delivery
The delivery date we show at checkout is an estimate, not a promise. Printing and shipping times are in the hands of our print partners and the carriers, and they vary.
We ship to the one address you give at checkout, so please check it. If a parcel comes back because the address was wrong or incomplete, we can't refund it, but we will reship it for the cost of postage.
If your order hasn't arrived within 10 days after the estimated delivery date, write to us and we will trace it. If it is lost, we reprint it free or refund you, as you choose. If tracking says it was delivered and you can't find it, tell us within 7 days and we will look into it with the carrier.
The order becomes yours, and the risk of loss passes to you, when the carrier delivers it to the address you gave.
9. Returns, reprints and refunds
Because each book is made for you from your photos, we can't take returns or give refunds if you change your mind or if there is a mistake in the proof you approved. You can still cancel before your order goes to print, as section 6 says.
If we got it wrong (a misprint, a manufacturing fault, the wrong item) or it arrives damaged, we will reprint it free or refund you, as you choose. Tell us within 30 days of delivery, with a photo of the problem. The full details are in the refund and reprint policy.
10. What you can send us
Only send content that is yours to use: photos from your own account, that you took or have the right to print, and words you wrote.
Do not send or order anything that:
- is illegal;
- is sexual content involving anyone;
- sexualizes, exploits or endangers a minor in any way;
- infringes someone else's rights, such as their copyright, trademark, privacy or right to control the use of their image;
- harasses, threatens or promotes violence or hatred against anyone.
We report apparent child sexual abuse material to the National Center for Missing and Exploited Children (NCMEC), as US law requires.
Your photos may show other people. You are responsible for having the right to print them.
We may refuse or cancel any order, at any time before it prints, if we believe it breaks these rules or if we can't make it to a standard we are happy with. If we do, we refund you in full.
11. Your content stays yours
You keep all rights in your photos and your words. We claim no ownership of them, or of your finished book.
You give us a limited permission to use your content only to make, check, print and deliver your order, to show you your proof and your order page, and to reprint it if needed. This permission covers the companies that help us do those things (hosting, AI providers, printers, carriers). It ends when we delete your files, as set out in the privacy policy.
We will not use your photos or your book in our marketing, and we will not use them to train AI models.
As far as we have any rights in the words the AI wrote for your book, we pass them to you.
12. Our site and brand
The Fondly Told name, logo, designs, templates, site and software are ours. You may use the site to make and order your own books. Please don't copy it, scrape it, interfere with it, or use it to make things for resale without asking us first.
13. Your AI assistant
Your AI assistant (for example Meta Muse) is made and run by another company. We don't control it. We aren't responsible for what it does, which photos it picks, what it tells you about us, or how it handles your Instagram account or your conversation. Its own terms and privacy policy cover that. We publish a guide that AI assistants can follow, but we can't promise every AI assistant follows it correctly. What counts is what you see on our pages and approve at checkout.
14. Copyright complaints
If you believe something printed through Fondly Told infringes your copyright, write to hello@fondlytold.com with: what the work is, where you saw it, your contact details, a statement that you believe in good faith the use is not authorized, and a statement under penalty of perjury that your notice is accurate and that you are the owner or act for the owner, with your signature.
15. If something goes wrong
We will make your order with reasonable care and skill. Beyond what these terms and the refund and reprint policy promise, and as far as the law allows, the service is provided "as is", without other warranties.
As far as the law allows, our total liability to you for any order is limited to what you paid for that order, and we are not liable for indirect or consequential losses, such as a gift that arrives after the day it was meant for. Nothing in these terms limits liability that the law says can't be limited, or takes away rights you have under consumer law.
16. Disputes and governing law
If you have a problem, write to hello@fondlytold.com first. Most things can be fixed by email.
These terms are governed by the laws of the State of Florida, USA. Any dispute that we can't settle by email will be heard in the state or federal courts in Hillsborough County, Florida, or in small claims court where you live if the claim qualifies.
17. Changes to these terms
We may update these terms. The new version will be posted here with a new date. The terms that apply to your order are the ones in place when you paid.
18. The rest
If a court finds part of these terms can't be enforced, the rest still applies. If we don't enforce something right away, we can still enforce it later. These terms, the refund and reprint policy and the privacy policy are the whole agreement between you and us about your order.
